Wíest, J.
While crossing a paved street in the city of Battle Creek, the forenoon of April 22, 1932, plaintiff was struck by an automobile, owned by defendant and driven by his 17-year old son, and was injured. She brought this suit to recover damages and, upon trial by jury, had verdict for $2,000 and judgment thereon.
Upon review defendant contends:
1. That plaintiff was guilty of contributory negligence as a matter of law;
2. The verdict'was contrary to the great weight of the evidence;
3. The court erred in refusing to instruct the jury to apply the rule of emergency as claimed by the driver;
