Plaintiff brought suit in circuit court to recover damages for personal injuries claimed to have resulted from defendant’s negligence in the operation of his automobile. The declaration filed in the case alleged that on the 7th of September, 1950, about 7 o’clock in the evening, plaintiff was riding a horse in a northerly direction on a certain highway in Emmett township, Calhoun county; that defendant so operated his vehicle as to run into the horse, striking the animal on the left flank; and that as a result plaintiff was thrown to the ground.
