CARDAMONE, Circuit Judge:

Jury service is an important federal function because it is a jury that historically has reflected the commonsense judgment of the community; it is the jury that serves as a counter to the exercise of arbitrary power. See Taylor v. Louisiana, 419 U.S. 522, 530, 95 S.Ct. 692, 697, 42 L.Ed.2d 690 (1975). But because some employers are hostile to the idea of their employees serving as jurors and threaten, harass or even discharge those who accept jury duty, Congress enacted the Jury System Improve- merits Act of 1978, Pub.L.
