I. Background
This case is before the Court on plaintiffs Motion To Strike Defendant’s Objection To Demand For Jury Trial, filed December 20, 1988. Defendant filed a response in opposition on January 17, 1989.
Plaintiff’s Complaint filed on October 12, 1988, alleges that defendants terminated her employment because of her service on a federal petit jury in the criminal trial of Carlos Lehder in violation of 28 U.S.C. § 1875. In the Complaint, plaintiff demanded a trial by jury. In their answer the defendants objected to plaintiff’s jury demand.…
