Plaintiff Liberty Mutual Fire Insurance Company (“Liberty Mutual”) brings this action, as subrogee of TAP Electrical Contracting Service, Inc. (“TAP”), to recover damages allegedly caused by the negligence of defendants E.E. Cruz & Co., Inc., Malcolm Pirnie, Inc., the City of New York, and the City of New York Depart ment of Environmental Protection during the course of a construction project in Flushing, New York.
