The defendant in error, the Scott County Drainage and Levee District, was organized on May 3, 1909, under the Levee act, as a drainage district, in the county court of Scott county. It embraces approximately 9000 acres of bottom lands in that county lying south of Mauvaisterre creek, a tributary of the Illinois river, and between the bluffs bordering the Illinois river valley on the east and the Illinois river on the west.
