(Dissenting.) I am unable to concur in the opinion of my associates either upon the holding striking out the state-' ment of the case or in affirming the judgment. I believe that upon the showing made in the district court the cause shown was amply sufficient, so far as appellant was concerned, for extending the time for preparing and settling the statement of the case.
