JOHN, Judge.
Petitioner Sonopress, Inc. (Sonopress), appeals the trial court’s order affirming an annexation ordinance (the Ordinance) adopted 18 May 1998 by respondent Town of Weaverville (Weaverville). For reasons set forth herein, we vacate the order and remand this matter to the trial court.
In light of our disposition, a detailed recitation of the underlying facts is unnecessary. In brief, the Town Council of Weaverville adopted a “Resolution of Intent of Annexation” (the Resolution) on 16 March 1998. Certain real property, including that owned by Sonopress, was thereby proposed for…
