LOWELL, Circuit Judge.

This is a petition for a writ of habeas corpus filed by Hubbard’s mother. The agreed facts are substantially as follows: Hubbard was born November 29, 1891. On January 21, 1898, he was duly committed to the custody of the Massachusetts State Board of Lunacy and Charity as a neglected child. From about April 1,1907, until November 8,1907, he was living at home with his mother, and working and contributing to her support.
