MEMORANDUM OPINION AND ORDER

VanARTSDALEN, District Judge.

I. Introduction

This action involves a challenge to administrative approval of construction of a highway commonly known as the Blue Route. The plaintiffs challenge the approval of the highway by the United States Department of Transportation, claiming failure to comply fully with several environmental laws including the National Environmental Policy Act (NEPA), 42 U.S.C. §§ 4321-4347, section 4(f) of the Department of Transportation Act, 49 U.S.C. § 303, and Executive Order 11,990, 42 Fed.Reg. 26,961 (May 25, 1977) (providing for…
