I. INTRODUCTION
The matter before the Court is the Motion for Summary Judgment filed by the Chapter 7 Trustee of the estate of Charles A. Landry (the “Debtor”) in the adversary proceeding brought against the Debtor, his spouse and his daughter. The Trustee seeks a determination that one-half of the remainder interest in property located at 26 Bisbee Road, Sau-gus, Massachusetts (the “Saugus Property”), which is held by the Debtor and his spouse as trustees, is property of the estate.
