This action arises out of a personal injury suit originally filed in the Superior Court of Arizona for Maricopa County, and later removed to this Court by Defendant Union Pacific Railroad Company on January 10, 2005 (doc. # 1). Currently pending before the Court is Defendant’s motion for summary judgment filed on July 29, 2005 (doc. # 15). Plaintiff filed a response in opposition to Defendant’s motion on August 30, 2005 (doc. # 17), and Defendants filed a reply on September 19, 2005 (doc. # 20).
