MEMORANDUM AND ORDER

CONABOY, District Judge.

Petitioner, Clyde Eugene Hill, presently incarcerated in the State Correctional Institution at Huntingdon, Pennsylvania, filed this habeas corpus action on March 10,1982, pursuant to 28 U.S.C. § 2254 (1966). In it he requests this Court to set aside his October 1972 criminal conviction in the Court of Common Pleas of Dauphin County, Pennsylvania, of two counts of second degree murder. 1 The principal ground raised in support thereof is that the trial court’s instruction to the jury placing the burden of proving insanity by a preponderance of the…
