Pending is Plaintiffs’ Motion to Remand. For the reasons stated herein, the motion is DENIED.
I. Factual Background
On June 3, 2003, 2,286 plaintiffs filed suit in the Circuit Court of Mason County, West Virginia, against the Western and Southern Life Insurance Company (“Western-Southern”) and seven individuals who were allegedly agents of Western-Southern (the “individual defendants”).
