I. INTRODUCTION
The plaintiff, Markel American Insurance Company (“Markel”), is in the business of writing and issuing policies of marine insurance. The defendant, Robert Madonna (“Mr.Madonna”), was the owner of a 2000 30 ft Crosby Hawk (the “vessel”) which was destroyed as a result of a fire at the Crosby Yacht Yard in Osterville, Massachusetts on December 10, 2003.
