Grand Valley Lakes Property Owners Association, Incorporated (“Grand Valley” or *264“plaintiff’) filed suit in the Chancery Court of Hardeman County against Burton Shearin (“Shearin” or “defendant”) and the substitute trustee under a deed of trust, seeking to restrain Shearin from foreclosing on certain property, and to have a deed of trust declared a nullity.
