DALLAS, Circuit Judge.
This case has been tried by the court, without the intervention of a jury, under section 649 of the Revised Statutes [U. S. Comp. St. 1901, p. 525].
Findings of the Court upon the Facts.
The plaintiff adduced in evidence a promissory note dated December 12, 1901, for $20,000, payable June 10, 1902, at 817 Drexel building, Philadelphia, signed, “American Alkali Company, A. K. Brown, President, Clayton E. Platt, Treasurer.” This note was payable to the order of the American Alkali Company, and was indorsed by the same officers of that company who had signed it. It was…
