WISDOM, Senior Circuit Judge.
The main question this consolidated appeal raises is whether a parent corporation assumed primary responsibility for industrial safety at a subsidiary corporation’s plant. A second question is whether newly discovered evidence, consisting of interoffice correspondence between the two companies, proved that the parent corporation assumed responsibility for safety at the subsidiary’s plant.
