Appellant was indicted.for the crime of murder, alleged to have been committed by the administering of poison. The jury found her guilty of murder in the second degree..

I. It is argued in her behalf that the verdict is a verdict of acquittal; that the crime alleged in the indictment was murder in the first degree; that there is no such erime- under our statute as murder in the second degree for a-homicide committed by means of poison.
