The appellant, John L. Cashin, Jr., was indicted on September 24, 1981, by the Madison County Grand Jury on six counts of theft of property in the first degree in violation of § 13A-8-3 Code of Alabama (1975). Appellant was arraigned on April 12, 1982, at which time the State moved to amend the charges to theft in the second degree. Represented by his retained counsel, Mr. Henry Mims, appellant consented to said amendment. Appellant, with retained counsel, made known to the trial court that he wanted to plead guilty to two counts of the indictment. Thereupon the State dismissed the other four…
