TAURO, District Judge.

This is a third party action brought by the New England Merchants National Bank (New England) against the Town Bank and Trust Company (Town). The court had diversity jurisdiction over the first party action and now exercises jurisdiction over this third party action pursuant to the doctrine of ancillary jurisdiction. 1 New England seeks indemnity from Town for a $56,750 settlement that it made with the Marine Midland Bank (Marine) and the Morgan Guaranty Trust Company (Morgan).
