On August 17, 1916, plaintiff and defendant entered into a contract in writing, which, omitting the formal parts, reads as follows: “Witnesseth, that the party of the first part agrees to deliver to the party of the second part on or about May 10, 1917, thirty head of mares and ten colts, yearlings, upon the payment by the party of the second part to the party of the first part, the sum of fifteen hundred dollars ($1,500.00).” At the time of the execution of this contract, plaintiff paid to the defendant the sum of $450 to apply on the…
