Plaintiff Misael Montalvo (“Plaintiff’), an inmate previously confined at the Erie County Holding Center (“ECHC”) commenced the instant action on May 15, 2014 (Dkt. 1). Plaintiff alleges that he is a diabetic and that, while incarcerated at ECHC, he was not provided with a medically appropriate diet, was not permitted to purchase food items from the prison commissary, and was the subject of false misbehavior reports when he complained about his dietary issues.
