On October 10,2008, Plaintiff filed suit in the Hanover County Circuit Court seeking compensatory damages as a result of injuries he sustained when he fell from the roof of a bam that was being built on Defendant’s property. Plaintiff’s Amended Complaint alleges that Defendant violated Occupational and Safety Health Administration (“OSHA”) regulations 1926.501(a)(2) and 1926.501(b)(1). 29 C.RR § 1926.501(a)(2) pertains to strength and support of walking areas; 29 C.RR. § 1926.501(b)(1) pertains to fall protection.
