Johnston, J.:

Susanna Koehler, as the personal representative of Karl Koehler, deceased, brought this action against the railroad company to recover damages sustained by reason of his death,, which occurred while he was in the service of the company, and which is alleged to have been caused by the negligence of its employés. On March 3, 1883, he was engaged with a number of others in loading rails on one of the cars of the company at Ellinwood, Kansas, and while so engaged a rail was thrown against him by the other employés of the company, which crushed…
