FENNER, Judge.
Appellant, Lester A. Kessler, appeals from an order of the trial court dismissing his action for mandamus, declaratory judgment and damages. This action involves the question of whether the respondent, City of Grandview, can lawfully withhold the issuance of a building permit for appellant’s not having paid what is referred to as a “Traffic Exaction”. Respondent, Jim Shay, is the building official for the City of Grandview responsible for issuing building permits.
