The present appeal involves the consideration of an application addressed to the judge of the District Court for a writ of habeas corpus, and the prayer of the petition is, that the Mother Superior of the St. Alplionsus Convent of Mercy, who is known to petitioner as Sister Philomena, be cited to answer, and that a writ of habeas corpus issue, directed to said Mother Superior, commanding her to produce, on the day specified, the body of Maria Theresa Prieto; *632and that after trial, petitioner, her mother, “be declared entitled to the care,…
