This matter is before the Court on cross-motions for summary judgment pursuant to CIT Rule 56. At issue is whether Defendant, the United States Customs Service (“Customs”), was correct in denying duty-free treatment to certain entries of aircraft engine parts by Pratt & Whitney, a division of Plaintiff, United Technologies Corporation (“UTC”).
