Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered November 27, 2002, convicting defendant upon his plea of guilty of the crime of attempted assault in the first degree.

Defendant was charged by indictment with attempted murder in the second degree, attempted assault in the first degree, assault in the second degree, criminal use of a firearm in the first degree and criminal possession of a weapon in the second degree in connection with an incident that occurred in the City of Albany wherein defendant shot another man in the legs.
