In 1994, the defendant was charged with possessing a firearm without a license in violation of G. L. c. 269, § 10 (a). Later that same year, the defendant, alleging State and Federal constitutional violations, moved to suppress evidence and statements made to the police. A District Court judge denied the motion after a hearing. The defendant subsequently failed to appear for his trial, and his whereabouts remained unknown until May, 2000, when he removed his default and requested reconsideration of the denial of his 1994 suppression motion.
