The plaintiffs made a contract with the defendant, the city of New York, in August, 1916, for the construction of that part of the subway known as route number 61 in consideration of the payment of $4,194,797. They assert the existence of a later contract by which the defendant, acting through the public service commission and the board of estimate and apportionment, undertook to pay to them the extra cost incurred through the advance in the price of labor and material as a consequence of the war.
