MEMORANDUM OPINION

BULLOCK, District Judge.

On September 16, 2000, Michelle L. Melvin (“Plaintiff’) suffered a personal injury at a store owned by Wal-Mart Stores, Inc. (“Defendant”) in Roxboro, North Carolina. Plaintiff brought this diversity action in the United States District Court for the Middle District of North Carolina on August 28, 2003. A summons was issued on October 16, 2003, forty-three (43) days after Plaintiff filed her action. Plaintiff served Defendant with the summons on October 29, 2003, pursuant to Rule 4(m) of the Federal Rules of Civil Procedure.
