This opinion is a companion opinion to that written by this Court in Close v. Calmar Steamship Co., and Calmar v. Jarka Corp. of Phila., 44 F.R.D. 398. Opinion filed February 15, 1968; all of these cases have been heard before a *414panel of this Court.1 Both opinions deal with cases which have arisen out of similar factual settings, i. e., a suit by a longshoreman to recover for injuries sustained as a result of the alleged negligence of the owner of the ship upon which the longshoreman was employed.
