This case comes to us by petition in-error from the district court of Logan county. [Hon. E. B. G-reen, Judge.]

The judge of the district court of Logan county, pursuant to the authority conferred by ch. 14, Statutes of Oklahoma, 1890, appointed three referees or commissioners, who qualified and proceeded to discharge the-duties imposed by said act.
