In this action, Plaintiff United Student Aid Funds, Inc., challenges a “Dear Colleague Letter” issued by the United States Department of Education (“DOE”). 1 That Letter bars “guaranty agencies,” like Plaintiff, from assessing costs on students loan borrowers who agree to a loan rehabilitation plan within 60 days of receiving a notice from the guaranty agency.
