Appeal from a judgment of the Supreme Court (McNamara, J.), entered May 16, 2007 in Albany County, which, in a combined proceeding pursuant to CFLR article 78 and action for a declaratory judgment, among other things, partially granted a motion by respondent HVFG, LLC to dismiss the petition.
