Goodwin presented to a Special Term of the Supreme Court, Onondaga County, a petition for an order, under article 78 of the Civil Practice Act, to review the determination of the respondent Graves dismissing him from the position which he held in the Department of Taxation and Finance of the State of New York and directing that the proceeding be transferred to a term of the Fourth Department for determination pursuant to section 1296 of the Civil Practice Act.
