DALZELL, District Judge.
I. Introduction
We consider here defendant Philadelphia Housing Authority’s (“PHA”) motion to dismiss plaintiffs second amended complaint pursuant to Fed.R.Civ.P. 12(b)(6).
Specifically, Daevonna McField, by and through her mother, Ravonnia Ray, brings this 42 U.S.C. § 1983 action against PHA, claiming that PHA violated her rights under the United States Housing Act, 42 U.S.C. § 1437 et seg.
