This appeal requires a review of a trial of au action before a jury by the administrator of William White against the Codell Construction Company, for the death of White, charged to have been the proximate result of the company’s negligence. The Codell Construction Company, a corporation, in November, 1931, and prior thereto, was under a contract with the state highway commission to build the Frankfort-Owenton Highway, Franklin county, Ky.
