OPINION

BUSTAMANTE, Judge.

{1} Defendant appeals from his convictions for trafficking a controlled substance and for disorderly conduct. We issued a calendar notice proposing summary reversal. The State responded with a timely memorandum in opposition to our proposed disposition. See Rule 12-210(D)(3) NMRA 1999. Having carefully reviewed the State’s arguments, and being unpersuaded, we reverse. FACTS
