McQUADE, Chief Justice.

This appeal is from a denial of a peremptory writ of mandamus seeking to have appellant’s name placed on the general election ballot as an independent candidate. The facts are not in dispute and may be briefly stated.

Appellant, Aaron L. Robinson, was an unsuccessful candidate for the Republican Party nomination for the office of County Commissioner, Bonneville County, District No. 3, at the primary election held in August, 1974.
