INTRODUCTION

Phillip E. Mendoza II appeals the decision of a review panel of the Nebraska Workers’ Compensation Court. The single trial judge found that Mendoza suffered an accident and injury to his left knee arising out of and in the course of his employment with Pepsi Cola Bottling Co. (Pepsi) on January 5, 1997. The review panel reversed the trial judge’s decision and found that Mendoza could not have been injured on that date.
