SULLIVAN, Justice.

Defendant Stevan Tompkins was charged with Murder, 1 Conspiracy to Commit Murder, 2 Felony Murder, 3 Robbery with a Deadly Weapon, 4 and Conspiracy to Commit Robbery with a Deadly Weapon 5 Defendant was also charged with being an Habitual Offender. 6 After a jury trial on October 14, 1994, defendant was found guilty of Murder and Robbery with a Deadly Weapon. At a separate hearing on October 15, defendant was also found to be an Habitual Offender.
