Pavers and Road Builders District Council Pension Fund (the “Fund” or “Plaintiff’) is a multiemployer benefit plan constituted under the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. §§ 1001 et seq., as amended by the Multiemployer Pension Plan Amendments Act (“MPPAA”), Pub. L. No. 96-364, 94 Stat. 1208 (1980). The Fund filed suit seeking to collect $614,960.00 in withdrawal liability, plus certain amounts of interest and liquidated damages, from Nico Asphalt Paving, Inc.
