ELLIS, District Judge.

At issue in this matter is whether the three defendants violated 21 U.S.C. § 846, Conspiracy to Possess and Distribute a Controlled Substance Analogue, when they represented to a purchaser that the pills they were selling him contained 3,4-me-thylenedioxymethamphetamine (MDMA), a federally-controlled substance, when in fact the pills contained nothing more than ginseng and vitamin B.
