MORGAN, District Judge.

In April 2002 the Defendant and a co-Defendant, Timothy Luken, were charged in a multi-count indictment. The indictment charged the Defendant with conspiracy to distribute and possess with intent to distribute MDMA (commonly known as “Ecstasy,” a schedule I controlled substance) and controlled substance analogues, namely 5-methoxy-N, N-diisopro-pyltryptamine (5-MeO-DiPT), also known as “Foxy,” and alpha-methyltryptamine (AMT), ten counts of distribution and possession with intent to distribute MDMA and controlled substance analogues, two counts of…
