Appeal from a judgment of the superior court for King county, Morris, J., entered April 20, 1907, upon conviction of the crime of assault with a deadly weapon with intent to do bodily harm, after a trial upon an information charging the crime of assault with,intent to murder.

William Constantine was informed against by the prosecuting attorney of King county for the crime of *220assault with intent to murder, committed with a revolver on the person of one Jesse M. Hall. To the information he pleaded not guilty, and on the issue thus made was tried by a jury, which returned a verdict finding him “guilty of assault with a deadly weapon with intent to do bodily harm.” On this verdict he was adjudged guilty by the court of the crime defined by Bal. Code, § 7058 (P. C. § 1575), and sentenced to a term of one year in the state penitentiary and to pay a fine of $5,000. From…
