The principal controversy in this litigation arises over an alleged assumption of a mortgage indebtedness made in an exchange of parcels of real estate. John Reinhart and Katie Reinhart, his wife, owned real estate in Florence, Marion county, upon which they had given a mortgage to the Guarantee Title and Trust Company to secure a loan of $5,700.
