It is averred in the petition that plaintiff eaused proper lists to be made of the swamp lands within the county and filed in the General Land Office as early as 1860, which lists were accompanied with the proper proofs, and from that time the plaintiff has made efforts to have the Commissioner of the General Land Office examine and pass upon the sufficiency thereof; that the defendant appeared before said commissioner and resisted the allowance of the claim made by plaintiff to said lands.
