OPINION AND ORDER
NORGLE, District Judge:
Before the court is defendant James B. King’s motion to dismiss pursuant to Rule 12(b)(1) and Rule 12(b)(6) of the Federal Rules of Civil Procedure. For the following reasons, the motion is granted.
FACTS
The action before the court is a suit by twenty-six Administrative Law Judges (“ALJs”) who adjudicate social security claims within the Department of Health and Human Services.
